1. Information on how to enter and prizes form part of these terms and conditions of entry.

2. Promotion commences at 9:01am AEST on 05/07/10 and finishes at 4:59pm AEST on 15/08/10 ("Promotion Period").

3. Entry is open to all residents of Australia. Employees and their immediate families of Kellogg (Aust) Pty Ltd and its associated parties are ineligible to enter the promotion. "Associated Parties" include without limitation, the agents and contractors of Kellogg that are involved in: (a) the promotion (including without limitation its development and conduct); and (b) the manufacture or distribution (up to the retailers) of Kellogg's products (including without limitation the manufacture of packaging). By entering this promotion you represent that you are eligible to enter.

4. To enter consumers must, during the Promotion Period, purchase specially marked Kellogg's® Breakfast Matters Promotional packs available in Woolworths and Safeway supermarkets nationally and follow the entry instructions in clause 6.

5. Participating packs are Kellogg's® All-Bran® Wheat Flakes Honey Almond 505g, Kellogg's® Corn Flakes 775g, Kellogg's® Just Right® 890g, Kellogg's® Mini-Wheats® 5 Grains 765g, Kellogg's® Nutri-Grain® 805g, Kellogg's® Special K® 600g, Special K Advantage® 600g, Kellogg's® Sultana Bran 820g.

6. Consumers enter simply by visiting www.breakfastmatters.com.au and answering the following details in 25 words or less "How do you Do Breakfast?" ("Entry Question"). Online entry form will require the product barcode number from a participating pack, receipt number, name, address, contact numbers, store purchased from, email address details and your answer to the Entry Question. Consumers will also choose whether their breakfast is ‘At Home', ‘On the Go' or ‘At Work'. This last question will determine which prize an entrant will win, in the event that the entrant is a winner. The prize chosen at the time of entry does not influence the likelihood that an entrant is chosen as a winner.

7. Entrants may be requested to produce their barcode and/or receipt to claim a prize. Where an entrant has entered multiple times the entrant may be required to produce the barcodes and/or receipts for each entry made. If a winner is unable to produce their barcode and/or receipt or barcodes and/or receipts when requested, they will forfeit their prize. Where a prize is forfeited, an alternative winner will be selected in accordance with clause 12.

8. Each entrant (determined by email address) will be limited to 5 successful entries per calendar day and a total of 15 successful entries throughout the promotion. Each entry must be submitted separately and must meet the requirements of these terms and conditions, and only one entry is permitted per receipt. Each entry must include a different answer to the Entry Question.

9. There is one prize to be won for each Woolworths / Safeway store nationally. There will be a total of 815 prizes awarded, (as per the number of Woolworths and Safeway supermarkets nationally at time of printing). Entries will be divided into the relevant store of purchase, as stated on the entry form and judged on a per-store basis. The best valid entry from each store will be the winner. Should a store or stores not have any entries the reserve entries selected in accordance with clause 12 will be judged, with the best entry or entries from these reserve entries winning the prize for that store or stores.

10. The judging will take place at The Marketing Zoo, 114 Christie St, St Leonards NSW 2065 commencing on 25/08/10. The winners will be notified by telephone and mail within 7 days of the judging.

11. The judges may select additional reserve entries for each store which they determine to be the next best, and record them in order. In the event that an invalid entry or ineligible entrant is selected as a winner, a prize is forfeited by a winner, or where a prize winner a cannot be contacted despite reasonable attempts to contact them, the prize for that store will be awarded the next best, non-winning reserve entry.

12. This is a game of skill and chance plays no part in determining the winner. All valid entries will be individually judged having regard to overall response including originality, creative merit and literary composition of the answer provided to the question. The judges' decision is final and binding and no correspondence will be entered into.

13. The prize won by each winner will depend upon whether they selected ‘At Home', ‘On the Go' or ‘At Work' on their entry form (refer to clause 6). The prizes consist of: (a) At Work – Sony 16GB S Series Video MP3 Walkman (Black) Model No NWZS745FB RRP $369.00; (b) At Home – Saeco Coffee Machine Model No Modo Mio Premium Silver RRP $399.00; (c) On The Go - Canon SD Flash Memory Camcorder Model No FS306 RRP $399.00.

14. In the event that the prize(s) specified is not available, the promoter has the right to provide an alternate model of the same or greater value.

15. Total prize pool value is valued at up to AUD$325,185.00 (incl. GST); depending on prizes selected. Prize value is correct at the time of printing. Kellogg accepts no responsibility or any variation in the value of any prize.

16. Winners and their details will be published on the Kellogg website on 07/09/10. Prize claims will be subject to security and verification checks.

17. Prizes cannot be redeemed for cash and are not transferable.

18. To the extent permitted by law, Kellogg's liability in relation to this promotion and/or any of the prizes is limited to the cost of replacement of any benefit or prize won.

19. Kellogg reserves the right to disqualify any person who tampers with the entry process (including fraud). Kellogg is not responsible for any technical malfunctions or problems with internet or network congestion, including injury or damage to a participant's or any other person's computer related to participation in this promotion and problems with transmission of entries over the internet. You consent to Kellogg using your personal information provided by your entry to undertake any investigation that Kellogg requires to determine whether there has been a tampering with the entry process.

20. Subject to any applicable law in the event of technical malfunction or any other matter that interferes with or has the potential to interfere with the proper conduct of the promotion, the Promoter reserves the right to suspend, cancel, modify or terminate the Promotion.

21. The Promoter does not accept responsibility for late, lost, misdirected entries or entries sent but not received by Kellogg. The judge's decision is final and no correspondence will be entered into. Entry details remain the property of the Promoter.

22. The promoter and their associated agencies and companies will take no responsibility for prizes lost or damaged in transit.

23. The promoter and their associated agencies and companies will take no responsibility for delays in transit out of the promoter's control.

24. Personal information supplied to Kellogg may be disclosed to third parties and/or used by Kellogg for the purposes of this promotion. Personal information may also be disclosed to third parties to determine whether an entrant has breached these terms and conditions. You consent to Kellogg so using or disclosing your personal information. Please contact Kellogg if you do not wish us to use your personal information for these purposes, or if you wish to access, correct or update the information.
